Surgeon Agreement
Last updated October 14, 2026
This agreement is between Fundbags LLC (“Fundbags,” “we”) and the surgeon and surgical practice listed on Fundbags (“you”). It applies in addition to our Terms of Service. By applying to be listed, or by using your surgeon portal, you agree to it.
1. Your credentials
- The listed surgeon holds an active, unrestricted medical license in each state where they operate on Fundbags patients, and is certified by the board named in your application.
- Augmentation procedures for Fundbags patients are performed in an accredited surgery center or licensed hospital.
- You keep medical malpractice insurance of at least $1,000,000 per claim and $3,000,000 aggregate, and upload a current certificate in your surgeon portal whenever the policy renews.
- You tell us within 10 days if any of this changes: a license restriction or discipline, loss of board certification or hospital privileges, a lapse or cancellation of your insurance, or a malpractice judgment or settlement.
- Everything you give us is true and complete. We may check it with licensing boards, certifying boards, insurers and public records.
2. Medical care is yours alone
- You alone decide whether a patient is a good candidate, which procedure and implants are appropriate, and how to care for her. You are responsible for consultations, informed consent, the surgery, and aftercare.
- Fundbags is a crowdfunding platform. We don’t practice medicine, give medical advice, refer patients, or guarantee that any patient will choose you.
3. Quotes and payments
- Written quotes you give Fundbags patients are accurate and itemize what they include: your surgeon fee, the surgery facility fee (including anesthesia), and implants or other charges, or say what’s excluded. Pricing you show on your listing is a good-faith estimate.
- Fundbags pays the full quoted amount to your practice. Your practice is responsible for paying the surgery facility, anesthesia provider and any other parties included in the quote, and the patient owes nothing more for anything the quote covered.
- Surgery funds are paid to your practice through Stripe after you confirm the patient’s surgery date. If a patient closes out her campaign early, she pays the remaining balance directly to you, and you confirm it’s paid or arranged before we send our payment.
- If a surgery we’ve paid for doesn’t take place (for example, it’s cancelled or she isn’t a candidate), you return the amount Fundbags paid within 30 days, less only charges for services actually provided that the patient agreed to in writing, so her supporters can be refunded.
- You don’t charge a Fundbags patient more for the same procedure than you quoted, or than you charge other patients, because her funds come through Fundbags.
4. Listings and advertising
- Your listing, photos, prices and website are truthful, don’t promise or guarantee results, and follow the medical advertising rules that apply to you.
- Featured and Premier placements are advertising, sold for a flat monthly fee. You never pay Fundbags per patient, per consultation or per surgery, and we never accept payment for steering a patient to you.
- We may edit or remove listing content that breaks these rules.
5. Patient privacy
- You protect patients’ medical information under the laws that apply to you, such as HIPAA and California’s Confidentiality of Medical Information Act.
- Don’t send Fundbags medical records or health details. To release funds, we only need the patient’s name, the surgery date, and (for a close-out) that her balance is covered.
6. Responsibility for claims
You will defend, indemnify and hold harmless Fundbags LLC and its owners from claims, losses and costs (including reasonable attorneys’ fees) arising from the medical services you or your staff provide, your listing content, or your breach of this agreement.
7. Suspension and ending
- Either of us may end your listing at any time. Your advertising subscription can be cancelled in your portal and runs to the end of the paid month.
- We may suspend your listing and hold payments if your license, certification or insurance can’t be confirmed, if we receive a serious complaint, or if we believe this agreement has been broken.
- Your obligations for funds already received continue after your listing ends.
8. General
California law governs this agreement. We may update it; if we make a material change, we will email you and ask you to accept the new version in your portal. Questions: support@fund-bags.com.
